Conditions of use
These terms of trade govern the sale and supply of goods by Ainsty Castings and may be subject to variation without prior notice.
Contract to buy
Orders placed will be treated as an offer to buy and Ainsty Castings reserve the right to decline any order in the case of obvious errors or inaccuracies regarding the goods or for the goods being unavailable. Ainsty Castings reserves the right to place restrictions on the volume of any goods ordered. By placing an order with Ainsty Castings it is understood that the customer has understood that Our model miniatures contain lead and are not suitable for use by persons under the age of fifteen THEY ARE NOT TOYS. That order implies a declared knowledge of this fact and it is the responsibility of the customer to ensure the end user of the goods meet the minimum age requirement in respect of purchase and use.
The prices and availability of the goods are specified on the Ainsty Castings website at www.ainsty-castings.co.uk and such information is subject to change without notice. If clarification is required, customers should contact us to confirm the current price when ordering by post, phone or fax.
All our prices are displayed with our products on our website www.ainsty-castings.co.uk in UK pounds, US dollars and Euros; the currency used for invoicing and payment will be determined by the country where the goods are requested to be delivered.
Import Taxes (outside the UK); Ainsty Castings is not responsible for any charges the customer may have to pay in taxes or customs duty. We suggest customers contact their local customs office to establish what additional charges may be incurred on importation.
Ainsty Castings will normally process orders within 14 days of receipt, please note that larger orders may take longer as items will be need to be cast to fulfill the order. Due to external influences, postal service customers may not receive the goods as fast as we would like. In the majority of cases customers receive their order within thirty days of making their purchase, at the delivery address supplied. Where the order consists of more than one package it is possible for them to be delivered on different days. Should customers have specific delivery requirements these should be noted on the order and we will advise if these are achievable.
Title of goods
Title to the goods will pass on full payment for the goods and Ainsty Castings takes no responsibility for the goods once they have been delivered to the address specified at the time of purchase.
We hope that all customers will be happy with their purchases from Ainsty Castings, however it is accepted that occasionally orders may be damaged during shipping, as such any damaged items will be replaced provided they are returned within 7 days of delivery. Any returns must be notified prior to shipping so that we can ensure that replacement product is available to be shipped. We would appreciate it if customers would send notice of return in the form of an email, letter or fax, stating clearly their full name and address, any relevant details of the purchase (order number etc) and that they wish to return the product, for replacement, to the following address: Ainsty Castings, The Potting Shed, Ranby, Lincolnshire, LN8 5LN, United Kingdom Tel: +44 (0)7799 262 451. Ainsty Castings recommends that registered post or recorded delivery is used for returning goods. Ainsty Castings will, within 30 days of receiving the notice of cancellation and the returned goods whichever is the later, replace without additional charge, any goods which have arrived in an unsatisfactory condition.
The right to cancel the contract exists from the time of the purchase the goods until the expiry of seven working days beginning with the day after the day that the goods were delivered. Where any part of the cancelled contract refers to goods that can be inspected without removing the packaging (blister packs for example) these items will only be accepted for return and refund if they remain unopened. Ainsty Castings reserves the right to request the return of any goods that are the subject of a cancellation order at the customers cost. Ainsty Castings recommends that registered post or recorded delivery is used for returning goods. Ainsty Castings will, within 30 days of receiving the notice of cancellation and the returned goods whichever is the later, reimburse without charge, any sum that has been paid for the goods. We would appreciate it if customers would send notice of cancellation in the form of an email, letter or fax, stating clearly their full name and address, any relevant details of the purchase (order number etc) and that they wish to cancel the contract to the following address: Ainsty Castings, The Potting Shed, Ranby, Lincolnshire, LN8 5LN, United Kingdom Tel: +44 (0)7799 262 451. Customers’ statutory rights are not affected.
Contracts between customers and Ainsty Castings shall be governed by English Law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
If for any reason any part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected unless the substantive purpose of the contract is then frustrated.
Limitation of liability
As far as is permitted by law, Ainsty Castings liability in respect of any claim arising in relation to the sale of goods shall not exceed the price paid for the goods in question.
